1. Agreement

These Terms govern participation in the Vitamart Affiliate Program ("the Program") operated by Live Pure Inc., operating as Vitamart.ca ("Vitamart," "we," "us"). By applying to or participating in the Program, you ("Affiliate," "you") agree to these Terms.

If you do not agree, do not apply and do not use any tracking link issued to you.

2. Eligibility and approval

To participate you must:

  • Be at least 18 years of age
  • Operate a website, newsletter, social channel, or professional practice with genuine audience reach
  • Promote primarily to audiences in Canada
  • Maintain content consistent with health and wellness, and not in conflict with Vitamart's brand

Applications are reviewed manually. Approval is at Vitamart's sole discretion and may be declined without reason. Submitting an application does not create an affiliate relationship. No relationship exists until Vitamart issues you a tracking link.

You may not hold more than one affiliate account. Duplicate accounts will be closed and unpaid commissions forfeited.

3. Commission

Category Rate
All products 8%
Subscription orders First order only. No commission on recurring renewals

Commission is calculated on the product subtotal after discounts, and excludes:

  • Shipping charges
  • Taxes (GST/HST/PST)
  • Gift cards, and any order in which a gift card is used
  • Orders that are cancelled, refunded, returned, or charged back
  • Your own orders, or orders placed by members of your household

Vitamart may adjust commission rates at any time on 14 days' notice. Rate changes are not retroactive to orders already placed. Higher rates may be offered on selected brands or campaigns from time to time.

Certain brands carry manufacturer pricing restrictions and may be excluded from commission. A current exclusions list is available on request.

4. Tracking and attribution

  • Cookie window: 30 days
  • Attribution model: last non-direct click

If a customer clicks another affiliate's link after yours and within the window, the later click takes the commission. Direct visits and traffic from Vitamart's own paid or email campaigns do not overwrite an existing affiliate cookie, but nor do they create one.

Tracking depends on the customer's browser accepting cookies and completing checkout in the same session context. Vitamart does not guarantee that every referred sale will be tracked and is not liable for commissions on sales that tracking does not record.

5. Prohibited promotional methods

The following result in immediate termination and forfeiture of all unpaid commission:

Paid search

  • Bidding on "Vitamart," "Vitamart.ca," "Vitacheck," "TRUMARK," or any misspelling, plural, or brand-plus-keyword variant in Google Ads, Bing, or any paid search platform
  • Using Vitamart trademarks in ad copy, display URLs, or landing page URLs
  • Direct linking to vitamart.ca from any paid search ad

Coupon and incentive traffic

  • Posting links or codes on coupon, cashback, deal, voucher, or loyalty sites or networks
  • Browser extensions, toolbars, or any software that injects affiliate tracking at or near checkout
  • Cashback or points-back offers to customers funded from your commission

Traffic quality

  • Purchased, incentivized, or bot traffic
  • Cookie stuffing, forced clicks, iframes, pop-unders, or any tracking injection without a genuine user click
  • Spam email, unsolicited SMS, or posting to forums and comment sections you don't own
  • Typosquatting or registering domains containing Vitamart trademarks

Marketplaces

  • Listing Vitamart products on Amazon, eBay, Walmart Marketplace, Facebook Marketplace, or any third-party marketplace

6. Content, claims, and disclosure

Disclosure is mandatory. Every post, video, article, email, or story containing your link must clearly disclose the material connection, in line with Competition Bureau of Canada guidance, Ad Standards Canada (ASC) codes, and FTC guidelines where applicable. Disclosure must be visible without clicking "more," and must not appear only in a bio, a hashtag block, or a video description.

Health claims. Canada regulates natural health product claims strictly. You may only make claims that appear on the approved product label or in the product's Health Canada licensing. You may not state or imply that any product treats, cures, prevents, or diagnoses any disease or condition, regardless of your professional credentials.

Do not:

  • Claim a product produces weight loss, cures illness, or replaces medical treatment
  • Present personal anecdote in a way that functions as a therapeutic claim
  • Use before/after imagery implying a health outcome
  • Compare Vitamart products to prescription medication

You are responsible for your content. If a regulator, platform, or complainant raises an issue with your content, Vitamart may require immediate removal.

Prohibited contexts. Do not place Vitamart links or content on sites containing adult material, hate speech, illegal content, or content directed at children.

7. Payment

  • Method: PayPal
  • Schedule: monthly, for commissions cleared as of the prior month end
  • Minimum payout: $50 CAD. Balances below the minimum roll forward
  • Hold period: 30 days from order date, to allow for returns and chargebacks

You are responsible for maintaining accurate PayPal details. Vitamart is not liable for payments sent to an address you provided in error.

Tax. You participate as an independent contractor, not an employee, agent, partner, or joint venturer of Vitamart. You are responsible for all taxes arising from commissions earned. If you are registered for GST/HST, you are responsible for invoicing applicable tax and for your own remittance. Vitamart may require your business number before releasing payment.

Unclaimed balances on accounts inactive for 12 months may be forfeited.

8. Trademarks and brand use

Vitamart grants you a limited, non-exclusive, revocable licence to use Vitamart's name, logo, and approved product imagery solely to promote Vitamart during your participation in the Program.

You may not:

  • Modify Vitamart logos or brand assets
  • Register any domain, social handle, or business name containing "Vitamart" or a confusingly similar term
  • Represent yourself as an employee, agent, or official representative of Vitamart
  • Issue press releases or make public statements on Vitamart's behalf

Third-party brand names and product images remain the property of their respective owners. Use of manufacturer assets is subject to those manufacturers' own permissions, which Vitamart does not grant on their behalf.

Your content. You retain ownership of content you create. By participating, you grant Vitamart a non-exclusive, royalty-free, perpetual licence to reproduce and display content you publish featuring Vitamart products, in Vitamart's own marketing channels, with attribution to you. You may withdraw this licence for future use with 30 days' written notice.

9. Affiliate product purchases

Approved affiliates may purchase Vitamart products at a discount off retail, at Vitamart's discretion. Where a discount or free product is provided:

  • Product is for your personal use, review, and content creation only
  • Resale is strictly prohibited. Reselling product purchased at a discount, or provided free of charge, on any channel — including marketplaces, social selling, or in-person — is grounds for immediate termination and forfeiture of unpaid commission
  • Standard shipping thresholds apply to discounted orders
  • Discounted purchases do not earn commission
  • The value of free product may be reportable as income; that is your responsibility
  • Receiving product or a discount does not obligate you to post, and does not obligate Vitamart to continue providing either
  • Vitamart may withdraw or vary the affiliate discount at any time

10. Inactivity

Accounts with no referred sales in 120 consecutive days may be deactivated. Deactivation does not forfeit commission already earned above the payout minimum. Reactivation is available on request.

11. Termination

Either party may terminate at any time, for any reason, with written notice. On termination:

  • Your tracking links are disabled
  • You must remove Vitamart links and branding from your channels within 10 business days
  • Commissions on qualifying orders placed before termination are paid on the normal schedule, unless termination was for breach

Where termination is for breach of Section 5 or Section 6, all unpaid commission is forfeited and Vitamart reserves the right to recover commissions already paid on affected orders.

12. Relationship of the parties

Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship. You have no authority to bind Vitamart or to make representations on its behalf. You are responsible for your own expenses, equipment, and business operations.

13. Disclaimer and limitation of liability

The Program is provided "as is." Vitamart makes no guarantee of earnings, traffic, conversion, product availability, or continued operation of the Program.

To the maximum extent permitted by law, Vitamart's total liability arising from the Program is limited to the total commission paid to you in the 3 months preceding the claim. Vitamart is not liable for indirect, incidental, consequential, or lost-profit damages.

Indemnity. You agree to indemnify and hold harmless Live Pure Inc., its directors, officers, and employees against claims, damages, and costs arising from your content, your promotional methods, your breach of these Terms, or your violation of any law or regulation — including advertising, health claim, privacy, and anti-spam legislation.

14. Changes, governing law, and general

Vitamart may amend these Terms at any time. Material changes will be communicated by email to your registered address at least 14 days before taking effect. Continued participation after the effective date constitutes acceptance.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties submit to the exclusive jurisdiction of the courts of Ontario.

If any provision is found unenforceable, the remainder stays in force. Vitamart's failure to enforce any provision is not a waiver of it.

These Terms, together with the Vitamart Privacy Policy, constitute the entire agreement regarding the Program.
